Abstract

May be given by a contractor to a provider of finance (funder) for proposed building works let or to be let under: a Standard Building Contract (SBC), an Intermediate Building Contract (IC), an Intermediate Building Contract with contractor’s design (ICD), or a Design and Build Contract (DB).

Document History

JCT 2005 Contracts should not be used for construction contracts entered into after 1 October 2011. Replaces JCT Standard form of agreement for collateral warranty for a funder (MCWa/F) (2001). Supersedes the 2005 edition. The principal revision is the incorporation of sustainability provisions, following JCT’s consultation, and provisions building on OGC’s Achieving Excellence criteria. Aspects of the payment provisions have been modified while awaiting the outcome of the proposed payment legislation.
