Abstract
Comprises a letter to Chief Planning Officers of local authorities, providing interim guidance regarding environmental impact assessment (EIA) following a recent European Court of Justice (ECJ) preliminary ruling, which requires planning authorities to give reasons for a negative screening opinion when requested by a third party. Also provides guidance on a High Court ruling that the assessment for likely significant environmental effects should not be restricted to a modification made to an existing development, but also to the effects of the development as a whole once it has been modified.
