Abstract

Provides advice on the planning process for dealing with proposals for nationally significant infrastructure projects (NSIPs). Gives a brief description of the legislative framework and obligations placed on both the decision maker and developer under the Habitats Directive and the Conservation of Habitats and Species Regulations 2010 (as amended); explains the interface between the process under the Planning Act 2008 and the process under the Habitats Directive (known as the Habitats Regulations Assessment (HRA)) which must be followed to ensure compliance with the legal requirements; clarifies the information to be provided with a development consent order (DCO) application as prescribed in the Infrastructure Planning (Applications: Prescribed Forms and Procedures) Regulations 2009; and highlights the relevant bodies that should be consulted throughout the DCO application process, the suggested timing of engagement and recommended level of interface required.

Under the Localism Act 2011, the IPC is abolished with its work being transferred to the National Infrastructure Directorate, created within the Planning Inspectorate.
