Abstract
Provides advice on legislation, procedures and good practice in development management in Northern Ireland. Discusses determination of planning applications, highlighting: legislative context; power to grant planning permission; determination of planning applications; powers to decline to determine subsequent (repeat) applications and overlapping (twin tracking) applications; duty to decline to determine applications where Section 27 of the 2011 Act not complied with (Section 50); assessment of environmental effects and EIA development; other legislative provisions; and effect of planning permission.
