Abstract
Comprises planning practice guidance focusing on the use of Habitats Regulations Assessment (HRA). Covers: what constitutes a HRA; when appropriate assessments may be required in the planning process; what an appropriate assessment must contain; mitigation measures; implications of the People over Wind judgement for HRAs; the key principles which can be considered by competent authorities when considering whether appropriate assessment is required; whether a project or non-strategic plan, such as a neighbourhood plan, rely on a more strategic level appropriate assessment such as that undertaken for a local plan; impact of People over Wind judgement on neighbourhood plans, permission in principle, development orders and planning zones; and the possible implications of the People over Wind judgement for undertaking an Environmental Impact Assessment.
