Abstract
Sets out proposals for amending the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 (SI 1999/293) in Wales, to take account of two related judgements of the European Court of Justice (ECJ). The essence of the ECJ judgements is that, where development consent comprises a multi-stage process (such as in an application for outline planning permission where, following outline consent, a further application has to be made to the local planning authority for the approval of certain reserved matters), it must be possible to allow for Environmental Impact Assessment (EIA) at the later stage if it has not been possible for it to be carried out or completed at the initial stage.
Document History
Consultation closed on 11 February 2008. No longer applicable as draft legislation superseded by Town and country planning (environmental impact assessment) (amendment) (Wales) regulations 2008 (W.198), SI 2008/2335.
