Abstract
Seeks views on the proposals to implement the Environmental Liability Damage (ELD) directive EC 2004/35. Looks at the obligations of those whose activities may cause or threaten to cause environmental damage, offences and penalties, enforcement and draft guidance.

This consultation package comprises: consultation document, this draft of regulations for England and similar draft regulations for Wales, draft guidance and an impact assessment. No longer applicable as draft regulations superseded by Environmental damage (prevention and remediation) regulations 2009, SI 2009/153.
