Abstract

Relates to the Town and country planning (determination of appeals by appointed persons) (prescribed classes) (amendment) (England) regulations 2009. SI 2009/380, which give appointed persons (planning inspectors) the power to determine additional classes of appeal instead of the Secretary of State. The Regulations transfer jurisdiction to determine appeals relating to old mining permissions under the Planning and Compensation Act 1991 and to determine certain appeals by statutory undertakers under section 78 or 174 of the Town and Country Planning Act 1990, in relation to their operational land or potential operational land.
