Abstract
Explains the procedures established by the Building (Scotland) Act 2003 and the Building (Scotland) Procedures Regulations 2004. They apply the Scottish Building Regulations to building work and deal with other matters covered by the Act, such as dangerous and defective buildings. Also covers: application of the building regulations, building warrants to build, convert or demolish, the role of Scottish Ministers, completion, appeals, compliance and enforcement, building standards register, building standards assessments, dangerous and defective buildings, verifiers, certifiers and relationships with other authorities.

Produced by Building Standards Division. Version 1.0 dated 27 September 2010 - New 3rd edition to reflect legislative changes in 2009 and 2010. This document replaces the 2nd edition published in 2007. Version 1.1 dated 2 May 2011 - Inclusion of Section 7 (Sustainability) and introduction of the Construction Products Regulations. Version 1.2 dated 9 January 2013 - Inclusion of new paragraph 3.2.15 for statement identifying feasibility of high-efficiency alternative heating systems with building warrant applications. Version 1.3 dated October 2013 - inclusion of information on the local authority performance framework, changes implemented by the Building (miscellaneous amendments) (Scotland) regulations 2013 and other general updates. Version 1.4 dated 02 February 2015 - inclusion of information on charging orders as introduced by the Buildings (recovery of expenses) (Scotland) act 2014. Version 1.5 dated 01 July 2017. The 3rd edition of the handbook incorporates legislation changes in: January and May 2009, October 2010 and January and October 2013. Version 1.6 dated 01/10/2019 - inclusion of additional information for the roles and responsibilities of the relevant person and the verifier from pre-application stage through to completion stage, including temporary occupation or use of buildings, CCNPs and CDM. Version 1.7 dated 1/4/2024 - inclusion of changes implemented by the Building (Fees) (Scotland) Amendment Regulations 2024 to increase building warrant fees from 1 April 2024. Also other minor amendments based on user feedback to improve understanding of the guidance presented in the handbook.
